
<p>The Supreme Court has adjourned the hearing of petitions seeking to declare marital rape a crime. A bench led by CJI DY Chandrachud said that since the arguments of the lawyers are yet to be completed, a verdict cannot be given before November 10, before CJI Chandrachud&#8217;s retirement. Therefore, a new bench will hear the matter after four weeks.</p>



<h2 class="wp-block-heading">CJI&#8217;s Retirement is Near</h2>



<p>The bench of CJI Chandrachud, Justice JB Pardiwala, and Justice Manoj Mishra was requested by the lawyers to adjourn the matter as CJI Chandrachud&#8217;s retirement is near. Both sides&#8217; lawyers argued that each of them would need a day to argue. Senior advocate Shankaranarayanan said that considering the material on record, they would need at least a day to present their arguments. He said, &#8220;This is a significant issue. My conscience does not permit me to suppress it. A lot needs to be said on this.&#8221; SG Tushar Mehta also requested a day to present his arguments. The CJI said that since each lawyer would need a day, it would not be possible to complete the hearing soon.</p>



<h2 class="wp-block-heading">IPC and BNS Provisions are Similar</h2>



<p>The bench had started hearing the petitions on October 17. Section 375 of the IPC, which has an exception in Clause 2, excludes marital rape from the definition of rape. Similarly, the Indian Penal Code (BNS) also has a similar provision, which came into effect on July 1 this year, replacing the IPC.</p>

<p>Jharkhand Mukti Morcha (JMM) released the list of candidates for five more seats in the Jharkhand Assembly Election on Wednesday evening. Yogendra Prasad has been made a candidate for the Gomia Assembly seat. He was the chairman of the State Backward Class Commission till recently. He has been an MLA from this seat before. The party has fielded Chamra Linda, the current MLA from Bishunpur, again. He had rebelled against the party in the recent Lok Sabha election and was suspended. However, after meeting CM Hemant Soren two-three days ago, he was granted a ticket again.</p>

<p>Sukhram Uraon will contest from Chakradharpur, Snehlata Kandulna from Khunti, and Jiga Susaran Horo from Sisai. The party has so far fielded candidates in 41 seats. Party&#8217;s central general secretary Vinod Kumar Pandey said that the announcement of candidates for one or two more seats will be made soon. Earlier, in the first and second lists, Hemant Soren will contest from his traditional seat Barhet, while his wife Kalpana Soren will contest from Gandey seat in Giridih district. Hemant Soren&#8217;s brother Basant Soren will contest from Dumka again. Nalin Soren, who was elected as an MP from Dumka Lok Sabha seat, has been given a ticket from Shikaripara, while Jagat Munda, son of Joba Munda, has been fielded from Manoharpur. Rajya Sabha MP Mahua Maji has been given a ticket from the Ranchi seat.</p>

<p>The party has dropped the ticket of its current MLA Dinesh William Marandi from Littipara. Instead, Hemlal Murmu has been given a ticket. <p>India&#8217;s star all-rounder Ravichandran Ashwin became the highest wicket-taker in the history of the ICC World Test Championship (WTC) on Thursday during the second Test against New Zealand at the Maharashtra Cricket Association (MCA) Stadium in Pune. Ashwin achieved this feat by dismissing New Zealand captain Tom Latham, opener Will Young, and Devon Conway on the first day of the match. With these three wickets, Ashwin has taken 189 wickets in 39 matches in the WTC, surpassing Australia&#8217;s Nathan Lyon, who has 187 wickets in 43 Tests.</p>



<p>Australia&#8217;s Test captain Pat Cummins is third on the list with 175 wickets in 42 matches. India&#8217;s fast bowler Jasprit Bumrah is seventh on the list with 124 wickets in 30 matches. The Post Office did not return 50 paise to the customer, now it will have to pay Rs 15,000


<p><strong>Consumer Commission Decision: </strong>A post office will have to pay Rs 15,000 as compensation for not returning 50 paise to a customer. Chennai resident Mansa went to the Polichalur post office in December 2023 to post a letter. The postal charge was Rs 29.50, but he paid Rs 30. He asked the post office clerk for 50 paise, but the clerk said that the system rounds off the amount to Rs 30, so 50 paise could not be returned. Mansa objected to this and offered to make the payment through UPI, but the post office refused, citing technical issues. He then filed a complaint with the Consumer Commission.</p>

<p>During the hearing, Mansa said that the practice of rounding off is a violation of consumer rights. On the other hand, post office officials said that digital payment was stopped due to technical issues. After hearing both sides, the Consumer Commission ruled that the post office had taken excess money due to software malfunction, which is an unfair trade practice under the Consumer Protection Act. The commission ordered the post office to pay Rs 15,000 as compensation instead of 50 paise.</p>

<p>Delay in justice is equivalent to denying justice, this saying has been heard for years, but the problem of delay in justice due to thousands of vacant posts of judges and magistrates in lower courts is not being resolved. According to government data, more than 20% of the posts of judges in the lower courts are vacant. Out of a total of around 25,000 posts across the country, 5,238 posts are vacant. In Uttar Pradesh alone, out of a total of 3,700 posts, 973 posts are vacant, which is the highest in the country. The situation is similar in Rajasthan, Madhya Pradesh, and Gujarat. The important thing is that most of the cases in lower courts are related to small crimes and disputes of the common man, the poor, and the villagers. Due to delays in decisions, the common man has to face time, labor, and heavy economic losses. At the same time, questions are being raised about the trust in the judiciary. It is noteworthy that there are around 4.49 crore pending cases in the lower courts of the country till October 22, 2024.</p>



<h2 class="wp-block-heading">This is the obstacle, delay in justice</h2>



<p>Efforts are being made to fill the vacant posts of judges in lower courts, but sometimes due to budget problems, delays in the examination process, or court disputes, the expected recruitment is not completed on time. In many states, new courts are being opened due to political reasons or changes in administrative units (new districts-tehsils), but new magistrates or judges are not being appointed immediately. This increases the number of vacancies. The vacancy of judges&#8217; posts does not mean that the cases of common people or their hearings are stopped. Every court has a link or alternative court. When the post of a judge is vacant in the main court, the hearing takes place in the link court, but due to the additional burden of pending cases, the disposal of cases is delayed, causing loss to the common litigants.</p>



<h2 class="wp-block-heading">The President,and the CJI had also expressed concern</h2>



<p>President Draupadi Murmu and the Chief Justice of India DY Chandrachud have expressed concern over the delay in the disposal of cases and its dangers, but the vacant posts of judges in lower courts are increasing instead of decreasing. Recently, President Murmu expressed her concern in a meeting of judicial officers, saying that people are withdrawing their cases due to the fatigue of litigation. CJI Chandrachud said in a program last month that people consider the court process as punishment and want to stay away from courts.</p>

<p>Maharashtra&#8217;s former minister Baba Siddique&#8217;s murder case is witnessing a series of arrests. Mumbai Crime Branch has arrested five more accused, taking the total number of arrested accused to 14, including two shooters.</p>



<p>In this case, the Crime Branch has arrested Amit Hisamsingh Kumar from Haryana. Amit had allegedly provided shelter to absconding accused Zeeshan Akhtar, who had arranged for the shooters.</p>



<p>A police officer said that Rupesh Rajendra Mohol (22), Karan Rahul Salve (19), and Shivam Arvind Kohar (20) were arrested from Pune. All three are said to be close to Shubham Lonkar. Shubham had taken responsibility for the murder on behalf of the Lawrence Bishnoi gang. He is still absconding. Gautam, the main shooter, is also absconding. Mumbai Police has issued a lookout circular against absconding accused Shubham Lonkar, Shivkumar Gautam, and Zeeshan Akhtar.</p>



<p>It is noteworthy that former minister and senior NCP leader Baba Siddique was murdered on the night of October 12, allegedly by shooters of the Lawrence Bishnoi gang in Mumbai. The 66-year-old leader was shot outside his son&#8217;s office in Bandra. The police arrested two shooters shortly after the incident. The arrested accused revealed during interrogation that they were connected to the Lawrence Bishnoi gang. So far, 14 accused have been arrested by the Mumbai Crime Branch in this case, and the search for others is ongoing.</p>

<p><strong>Nawazuddin Siddiqui:</strong> Actor Nawazuddin Siddiqui has once again landed in controversy. His troubles have increased after a recent advertisement. In the advertisement, the actor is seen wearing a Maharashtra police officer&#8217;s uniform.</p>



<p>Nawazuddin is seen encouraging people to play poker on an app. According to a recent report, a Hindu organization has claimed that the advertisement is damaging the reputation of the Maharashtra police by linking it to gambling. The Hindu Janajagruti Samiti has written a letter to the Mumbai Police Commissioner and the Director-General of Maharashtra Police, demanding action against Siddiqui and Ankur Singh, the owner of Big Cash Poker.</p>

<h2 class="wp-block-heading">Demand for Strict Action </h2>



<p>Surajya Abhiyan&#8217;s Maharashtra state coordinator Abhishek Murukate has written a letter to the Mumbai Police Commissioner and the Director-General of Maharashtra Police, raising this issue. The letter demands strict action against Siddiqui and Singh under the Maharashtra Civil Service (Discipline and Appeal) Rules 1979 and the Maharashtra Police Act 1951.</p>



<h2 class="wp-block-heading">Hindu Janajagruti Samiti</h2>



<p>The letter states, &#8216;It is disturbing because the police department registers cases against such people and arrests gamblers. The Hindu Janajagruti Samiti&#8217;s Surajya Abhiyan strongly condemns this, as it tarnishes the image of the Maharashtra police. If ignored, it may lead to more illegal and unethical advertisements using the police uniform.&#8217;</p>



<h2 class="wp-block-heading">Advertisement Harmful and Insulting to Law Enforcement</h2>



<p>The letter further states, &#8216;It is disappointing that no police officer has been forced to take action against this application and it is unfortunate that others have to complain.&#8217; &#8216;We also want the Home Minister of Maharashtra to take cognizance of this matter.&#8217;</p>



<p>The Hindu organization has emphasized that the advertisement is harmful and insulting to law enforcement. The Hindu Janajagruti Samiti has also demanded action from the Home Minister of Maharashtra, Devendra Fadnavis, in this matter. Nawazuddin has not yet stated this matter.</p>

<p><strong>Delhi Murder Case: </strong>A sensational case has come to light in the capital Delhi. A woman living in Mukundpur killed her live-in partner. Munni, a resident of Mukundpur, murdered her lover Mohammad Tawarq alias Sahil Khan with a stone (silbatta), hammer, and knife. The Delhi police said that the 28-year-old widow, who has four children, reached the police station eight hours after the incident and confessed to the crime. The accused woman told the police that she killed her lover because he was a drunkard and used to misbehave with her and her children.</p>



<p>According to the police, the incident took place on Tuesday. Munni, a resident of Gali No. 1, Rama Garden, Mukundpur, reached Bhalswa Dairy police station and told the police that she had been living with Sahil Khan for a long time and had killed him with a stone, hammer, and knife in their house.</p>



<h2 class="wp-block-heading">How was the murder committed?</h2>



<p>The police said that during questioning, it was revealed that the woman&#8217;s husband Banti Yadav had died in 2018, and she had been living in Mukundpur since then. She has four children, one daughter and three sons.</p>



<h2 class="wp-block-heading">Who is Sahil Khan?</h2>



<p>The police said that Sahil Khan was married and had a child. The accused woman had gone to her village in Khagaria, Bihar, a month ago and asked Sahil to leave her house, but he refused. On Tuesday, Sahil came home around 1:30 pm in a drunken state and started troubling the woman. Fed up with his behavior, the woman killed him.</p>



<h2 class="wp-block-heading">The body sent for post-mortem</h2>



<p>The police immediately confirmed the murder and sent the body for post-mortem. During the investigation, it was found that the woman had killed her partner with a hammer, silbatta, and knife. The police have seized the weapons used in the crime.</p>

<p><strong>Bihar By-Poll 2024: </strong>Four assembly seats in Bihar are undergoing by-elections. In the meantime, the Grand Alliance has suffered a major blow. Congress leader Parshuram Tiwari has resigned from the party. Parshuram Tiwari has sent his resignation to Congress President Mallikarjun Kharge. After his nomination, old Congress leader Parshuram Tiwari, who hails from the same region, has resigned from the party. Notably, Parshuram Tiwari has been associated with Congress for nearly two decades. He has sent his resignation directly to Congress President Mallikarjun Kharge. Parshuram Tiwari has been a Congress candidate from the Ramgarh assembly seat twice in the past. In his statement, he said that the Congress party in Bihar has become a puppet of RJD. The party and the alliance are being run by people who support familyism, and it is no longer possible for him to stay with the party. Therefore, he is resigning from the primary membership of the party.</p>



<h2 class="wp-block-heading">Voting to Take Place on November 13</h2>



<p>It is worth noting that the MLAs who have become MPs from Ramgarh, Tarari, Belaganj, and Imamganj seats are undergoing by-elections. Voting for these seats will take place on November 13, and counting will take place on November 23. Candidates can file their nominations till October 25, and the scrutiny of nominations will take place on October 28. Candidates can withdraw their nominations till October 30.</p>

<p>Before Diwali, the government provided a big relief to common people by announcing to sale of pulses at a 25% discount at certain places. The prices of pulses have been rising rapidly in India. In the meantime, the government is providing cheap pulses under the Bharat brand at 20-25% lower prices than the market rate. The Department of Consumer Affairs has expanded its subsidized pulse program, offering whole chickpeas and masoor dal at lower prices. With this initiative, chickpeas, moong, and masoor dal can be purchased at discounted prices.</p>



<h2 class="wp-block-heading">Where to buy cheap pulses</h2>



<p>These pulses can be purchased through cooperative retail networks and e-commerce platforms.</p>



<h2 class="wp-block-heading">25% discount on pulses</h2>



<p>Whole chickpeas can be purchased at Rs 58 per kilogram, chickpea dal at Rs 70 per kilogram, moong dal at Rs 107 per kilogram, whole moong dal at Rs 93 per kilogram, and masoor dal at Rs 89 per kilogram. &#8216;Bharat Dal&#8217; will be sold through mobile vans. The second phase of &#8216;Bharat Dal&#8217; has started, and Union Minister of State for Consumer Affairs, Food, and Public Distribution, Prahald Joshi, said, &#8220;This initiative confirms the government&#8217;s commitment to ensuring the availability of essential food items at affordable prices to consumers.&#8221; This facility will be provided through cooperative societies like NCCF, NAFED, and other channels.</p>



<h2 class="wp-block-heading">Cheap onions are also being sold</h2>



<p>Under the second phase of &#8216;Bharat Dal&#8217;, the government is selling pulses from its buffer stock to maintain price stability. The government has allocated 3 lakh tons of chickpeas and 68,000 tons of moong for distribution. With the resumption of &#8216;Bharat Dal&#8217; sales, there is a possibility of increased supply to consumers during the festive season. Moreover, the government has purchased 4.7 lakh tons of onions from the rabi crop to stabilize prices. The government started selling onions from its buffer stock on September 5 and has so far sold 1.15 lakh tons. NCCF has sold onions through 77 centers in 21 states, and NAFED has sold through 43 centers in 16 states.</p>


<p> Bharat Dal: With the government&#8217;s initiative, chickpeas, moong, and masoor dal can be purchased at discounted prices. </p>
